Yes but they didn't have an exclusive contract that promised SiriusXM pure exclusivity of their program.
That is the difference.

As I look back on this the more I see how the entire mess truly was created by one person and one person alone; Art Bell.

I love Art, but what would possess him to sign yet another non-compete? Especially after having to wait 10 years to get out of the last one?
